- Before or at the time of collecting personal information, we will identify the purposes for which information is being collected.
- We will collect and use personal information solely with the objective of fulfilling those purposes specified by us and for other compatible purposes, unless we obtain the consent of the individual concerned or as required by law.
- We will only retain personal information as long as necessary for the fulfillment of those purposes.
- We will collect personal information by lawful and fair means and, where appropriate, with the knowledge or consent of the individual concerned.
- Personal data should be relevant to the purposes for which it is to be used, and, to the extent necessary for those purposes, should be accurate, complete, and up-to-date.

I. Personally-Identifiable Information and Non-Personally Identifiable Information.
BlackWire Marketing, LLC (also referred to herein as “BlackWire”) may collect two different types of information, Personally Identifiable Information (“PII”) and Non-Personally Identifiable Information (“Non-PII”). PII is information that identifies you as an individual - for example, your name, address, telephone number, e-mail address, credit card information, billing address and shipping information. Non-PII is aggregated information, demographic information, IP addresses, user behavior data from web interaction metrics tools and other information that does not reveal your specific identity. PII and Non-PII may be collected anytime you access or use a BlackWire website. PII and Non-PII may also be collected by BlackWire during in-person discussions, telephone conversations, and electronic or other written communications. BlackWire also collects information via cookies; blocking cookies may render you unable to access certain BlackWire products, services, or websites.
BlackWire uses PII to respond to your inquiries, provide you with services you have requested, keep you informed of services BlackWire thinks may be of interest to you, and otherwise personalize your experience with BlackWire , and other reasons. BlackWire does not sell or lease PII about you to others. BlackWire may share PII with BlackWire affiliates and third parties contracting with BlackWire to provide services to you, e.g., financial institutions. BlackWire may also share PII when required by law, or when you have expressly requested BlackWire to do so. BlackWire reserves the right to disclose and use your PII if BlackWire believes it is necessary to: (a) respond to legal process, e.g., a subpoena; (b) respond to a law enforcement agency’s request; (c) enforce the Terms; or (d) protect the rights, privacy, safety, property, or operations of BlackWire or third parties;
Because Non-PII does not personally identify you, BlackWire reserves the right to use and disclose to third parties Non-PII for any purpose.
BlackWire maintains reasonable physical, administrative and technical safeguards to protect PII from loss, misuse, or unauthorized access, disclosure, alteration or destruction. BlackWire enforces its Privacy Policy via self-assessment.
BlackWire reserves the right to change this privacy notice, which changes will become effective upon posting of the revised notice https://blackwiremarketing.com/legal, or upon emailing of the changes to you at the email address you provided to BlackWire , or as required by law.
II. Links to or From Other Sites
Except where expressly stated by BlackWire, BlackWire LLC is not affiliated or associated with operators of any third party websites that link to or are linked from any BlackWire-maintained website. BlackWire disclaims any responsibility for the accuracy or content of information found on third party websites that link to or are linked from any BlackWire website. BlackWire disclaims any responsibility for the security of any information (including without limitation credit card and personally identifiable information (“PII”)) that you may provide to any third party. BlackWire reserves the right, at any time and in its sole and absolute discretion, to block links to any BlackWire-maintained website through technological or other means without prior notice.
III. Information; Registration; User Names and Passwords
As a BlackWire website user, You will be required to create an account with BlackWire . You warrant that the information you provide BlackWire is truthful and accurate, and that you are not impersonating another person. You are responsible for maintaining the confidentiality of any password you may use to access your BlackWire account, and you agree not to transfer your password or User name, or lend or otherwise transfer your use of or access to your account, to any third party. You are fully responsible for all transactions with, and information conveyed to, BlackWire under your account. You agree to immediately notify BlackWire of any unauthorized use of your password or User name or any other breach of security related to your account. You agree that BlackWire is not liable, and you will hold BlackWire harmless, for any loss or damage arising from your failure to comply with any of the foregoing obligations.
IV. Release/Authorization to Use Photographs
You grant BlackWire permission to use any and all photographs, or video or audio or digital recordings, taken by BlackWire or its agents or employees, or submitted by You to BlackWire (hereinafter “Photographs”) in any Media (including print, internet, film, television and no matter how distributed or published) for any purpose, which may include, but shall not be limited to, advertising, promotion, marketing and packaging of BlackWire or any product or service sold and marketed by BlackWire . You agree that this authorization to use Photographs may be assigned by BlackWire to any other party. You agree that that the Photographs may be combined with other Photographs, sounds, text and graphics, and that the Photographs may be manipulated, cropped, altered or modified in BlackWire ’ sole discretion. You agree not to charge a royalty or fee, and not to make any other monetary assessment against BlackWire in exchange for this Release and Assignment. You hereby release and forever discharge BlackWire from any and all liability and from any damages you may suffer as a result of the use of the Photographs. You further acknowledge and agree that this Release is binding upon your heirs and assigns. You agree that this Release is irrevocable.
GDPR
The General Data Protection Regulation (GDPR) is a recent European regulation replacing the current European Union (EU) Data Protection Directive. Its purpose is to ensure the security and protection of the personal data of people in the EU (residing or transitory). It is, essentially, a "Bill of Consumer Data Rights." While BlackWire Marketing LLC is not based in the EU, many of its customers are and will be. The GDPR regulates the processing of data, which includes the collection, storage, transfer or use, of personal data about EU individuals. Thus, where EU data is concerned, the company will have to comply with GDPR as well. Rather than maintain two levels of data security, we have opted to elevate our security and processing standards to GDPR-mandated levels for everyone.
Yes. BlackWire Marketing LLC will be compliant on or before 25 May 2018, the date the GDPR comes into force in the EU. We have a deep commitment to the privacy and security of your data, as well as your ability to access it. Maintaining compliance to GDPR constitutes no significant change in our philosophy or business practices.
That's up to you. Our company will be GDPR compliant by 25 May 2018, and will ensure that tools exist such that BlackWire Marketing LLC vendors can be GDPR compliant. But, while we may provide the tools to its vendors to ensure they can be GDPR compliant, it is the responsibility of the individual vendor to ensure that its business is compliant.
Because the spirit of the GDPR is in line with BlackWire Marketing LLC philosophy and values, with an emphasis on customer data security and privacy, compliance with the GDPR has been more a matter of codifying our policies than a radical shift in our business model.
Security and Privacy:
Data privacy is of paramount importance to us. To that end, not only have we employed industry standard best practices, but we have also contracted a world class security firm to ensure BlackWire Marketing LLC is fortified against breach. We are ensuring that our vendors can adhere to the highest customer opt-in standards.
Assurance of Rights:
Our goal is to allow you, the customer, to exercise your rights under the GDPR, including transparent access to data, and protection from unauthorized use of said data. Our practices will ensure these rights.
Do these changes affect BlackWire Marketing LLC customers in any way?
Yes. As stated above, we can provide updated contractual terms for you, and we can facilitate your compliance with the GDPR. The rest is up to you.
This page was updated on 1st May 2018 and replaces the prior version in its entirety.
